1. GENERAL PROVISIONS

This Data Protection Policy applies to the online platform https://www.translinegroup.pl (the “Site”), managed by the Limited Liability Company Staff In Sp.z.o.o. with its registered office in Wrocław at Pl. Legionów 2, 50-047 Wrocław, registered in the District Court for Wrocław-Fabryczna in Wrocław, VI Economic Department of the National Court Register under KRS no.: 0000524280, the amount of share capital: PLN 26,000 (twenty-six thousand), NIP 9512381837, REGON 147341916 (“Staff In”). For more information on how to contact us, see Chapter 13 of this Data Protection Policy.

We take your privacy very seriously. Your personal data will not be sold or rented by us. All data will be collected, stored and managed by us in accordance with European Union Data Protection Regulation No. 2016/679, the provisions of other legislation, and will not be transferred by us to third parties, except where we are required to do so by law or it is necessary to provide our services, or you consent to the transfer of your data.

The provision of services through the website (the “Platform”) is only possible through the collection, storage, transmission, deletion and/or other use of data specifically related to you (“Process” or “Processing”). Personal Data is defined as information about a person whose identity has been or can be identified (“Personal Data”), such as name, surname, date of birth, address or email address.

This Data Protection Policy describes which of your Data is collected by us and for what purpose Processed when you use the services provided on our Platform. This Policy also contains important information about Data Protection, in particular regarding the rights guaranteed by the legislature.

Some of the services available on our Platform are provided by third parties. When using such services, this Data Protection Policy is also subject to the provisions of the third party’s Data Protection Policy. Before using such services, the third party may ask for your consent in accordance with applicable data protection laws.

This Data Protection Policy supplements the general principles (the “Principles”) that form the basis of your Agreement with “Staff In” to use the Platform (the “Use Agreement”). In the event of any discrepancy between the Principles and the Data Protection Policy, the provisions of the latter document shall govern.

2. WHICH OF YOUR DATA DO WE PROCESS?

2.1 Logging in to the Website

When you enter and log in to the Website, even if you do not have a user account, we process the following data about you (log files):

• IP address of your device;
• information about the browser used by your device;
• the content and unique addresses (URLs) to which you connect;
• the date and time of your login.

If you log in via mobile devices, the following log files are also recorded:

• model and manufacturer of the mobile device;
• the operating system of the mobile device (“iOS”, “Android”).

Without your express consent, we will not use the above-mentioned personal data, in particular the IP address, except as necessary (i) to provide the services and (or) (ii) for security purposes, in particular – against cyber-attacks, such as the collection of personal data, or to prevent intervention attacks and unauthorized programs.

2.2 User registration

In order to use certain features of the Platform, in particular – ……………………………., it is mandatory to create a user account “Staff In”. For this purpose, user registration on the Site or Application is mandatory. If you have a “Facebook” or “Google” account, it is possible to register via one of these accounts.

(a) Registration through a “Facebook” or “Google” account.

If you register via a “Facebook” or “Google” account, you will be redirected from the “Staff In” website to the “Facebook” or “Google” website and asked to enter your “Facebook” or “Google” account login information. After entering the login information for the “Google” account, “Staff In” will receive the following account user information from “Google”:

• Profile photo
• First name
• Last name
• Email address
• After entering the login data for the “Facebook” account and finding yourself on the “Facebook” page, there is an opportunity to decide whether, together with: the public profile (exactly – the user’s name, gender information, profile photo), other user data of the “Facebook” account are to be shared, ie:
• list of friends and (or)
• e-mail address

Please pay special attention to the fact that if you leave the default settings, all the above-mentioned data from the “Facebook” account will be selected. If you press the “Continue as…” button. (English: “Continue as…”), you will agree to transfer the selected data from the “Facebook” account for “Staff In”.

The data imported from your “Facebook” or “Google” account will be used to create your “Staff In” user account. This means that your “Facebook” or “Google” username will be used as your “Staff In” username, which will be visible to visitors to the Site. Other data imported from the “Facebook” or “Google” account will not be visible to anyone on the Platform.

It is possible to disconnect the “Facebook” or “Google” account at any time. This can be done after logging into the “Staff In” account, under the “My settings” tab. If you register without using a “Facebook” or “Google” account, you can connect them later.

(b) Registration without using a “Facebook” or “Google” account

In the case of registration without using a “Facebook” or “Google” account, the following information must be entered on the Application Site:

• User name (required)
• Email address (required)
• Password
• Confirmation that the age of the user is over 18 years old

The username will be visible to all users of the Platform. Other data provided during registration will not be visible. The username may be a pseudonym and should not be the same as your real name.

3. purposes for which we process your dan

In addition to those described in the 2nd paragraph, we process your Data for the following purposes:

3.1 Provision of our services

Your Data will be processed by us executing the Usage Agreement in order to provide the services you use on our Platform, and:

• to provide the conditions for you to learn about our business profile
• in order to identify
• to present job offers that might be of interest to you
• in order to provide services avoiding technical errors and to identify errors and correct them.

3.2 Rights guaranteed by laws, improvement of the Platform, identification and prevention of unauthorized activities, system security

Your data will also be processed by us to protect the following legitimate interests of “Staff In” and (or) third parties:

• Dispute resolution, compliance with, performance and protection of the Terms and Conditions and rights
• Analyzing and evaluating the use of the Platform in order to continuously improve products and services
• Ensuring the security of the Platform and the Data stored on it, preventing cyber-attacks and other threats to the integrity of the Platform.

4. Online security

Access to your account is protected by the password you set. Thus, this password should not be disclosed to anyone. When ending the use of “Staff In”, you should log out by pressing the “Logout” button, especially when using a public computer. Please note that data transmission over the Internet (e.g. by e-mail) is not always completely secure and there is no way to ensure protection from third parties.

We will take all necessary technical and administrative security measures necessary to protect your Data from unauthorized loss and access and from unauthorized alteration, disclosure or deletion. Your Data will be made available only to those persons who need it for the purposes described in this Data Protection Policy. Such persons are covered by applicable data protection laws.

5. Data processing transferred to third parties

In order to provide certain services, “Staff In” may employ third-party service providers. Such service providers perform data processing procedures on our behalf and in accordance with our instructions. Third parties that handle personal data are selected carefully and in accordance with applicable data protection regulations. We also ensure that data processing is carried out in accordance with signed agreements with third countries and legal acts.

Procedures carried out on our behalf include:

• providing technical infrastructure for the Platform and providing space on local servers
• data transfer
• analysis of usage
• account verification
• customer service and inquiry processing
• payment processing and secure invoicing
• Platform maintenance and security (e.g., fraud and harassment prevention).

Under certain circumstances, our third-party service providers may have access to your Personal Data, but only for the purpose of data processing. Such third parties are contractually obligated to provide a level of data protection at least equivalent to that used by “Staff In” and in compliance with legal regulations. All data processed on our behalf remains under our control. We continuously monitor compliance with our guidelines, data protection levels and contractual obligations with the data processor.

Some of the service providers may be from countries outside the EU / EEA areas, where the level of data protection against EU / EEA standards may be considered insufficient. Nevertheless, we have appropriate agreements (or other valid guarantees) in place with such service providers to ensure that all necessary measures are taken to protect data in accordance with applicable regulations. 7. Sharing of data with third parties

“Staff In” is legally obligated to provide Personal Data and/or data on the use of the Platform to governmental or supervisory authorities to the extent necessary for the prevention of public risks and the prosecution of crimes.

In all other cases, your Data will be transferred to third parties, only if you consent and share your Data (excluding third parties, see section 5 above).

8. USE OF COOKIES

8.1 Necessary cookies

Cookies are small text files that the Platform wants to host on your computer or other Internet-connected devices, such as tablets or smartphones. If your browser settings accept cookies, your browser adds a small text file.

Unless otherwise specified in this data protection policy, the use of cookies is necessary for the functionality and operation of the Platform. This applies to cookies that enable you to register for the secure portion of our Platform. Most cookies from your device are deleted when your browser session ends (session cookies). The information stored in required cookies is only used in providing preferred services and features. We use required cookies only to provide the services and features we need.

8.2 Cookie Permission

When you access the registration page of our Platform, by displaying a cookie message and obtaining your consent, we will ask you to place additional cookies on your device. These cookies are not necessary for the functioning and operation of the Platform, although they help us:

• Determine how many visitors visit the Platform and how they behave. This helps us improve the functionality of the Platform, e.g., ensuring that the person searching for an item finds what they are looking for (analytics cookie).
• Identify when you visit the Platform a second time. This allows us to personalize the message, content, greet you personally with your name, and highlight your options (functional cookies).
• Capture visits to our Platform and information about the pages you visit and links you click. We use this information to better tailor our Platform and advertising to your needs. If you allow marketing messages to be sent to you (see Section 3.4 below), this information will also be used by us to offer personalized marketing information (targeted cookie).

The cookie report contains information about why we use cookies. By continuing to use our Platform after the cookie message is displayed, you agree that we will use cookies for the above purposes (the “Cookie Regulation”). 8.3 Managing your cookie settings

It is possible to configure your browser to reject some or all cookies or ask for your consent to accept them. However, if you opt out of cookies, some of our services may be limited. For information on how to change your browser settings, please visit www.aboutcookies.org or www.allaboutcookies.org. When connecting to the Platform using multiple devices (such as a smartphone, tablet, computer, etc.), please ensure that each device’s browser is adjusted to your cookie preferences.

8.4 Use of “Google Analytics”

This website uses the web analytics service “Google Analytics”, “Google Inc.” (Google). “Google Analytics” uses cookies, text files that are stored on your computer and that enable analysis of the use of the Site. The information generated by the cookie about your use of the Site, usually transmitted to and stored on a Google server in the USA. We have IP anonymity activated on the Platform, and in EU member states and other countries of the European Economic Area that have an agreement, your IP address will be shortened by “Google” beforehand. The full IP address is transmitted and stored on a “Google” server in the USA only under exceptional circumstances. Google uses this information on behalf of “Staff In” for the purpose of evaluating the use of the Website, creating reports on website traffic and for the purpose of “Staff In” additionally providing services related to the use of the Website and the Internet. As part of the “Google Analytics” activity, the transmitted IP address of your browser is not associated with other data held by “Google”. You can prevent cookies from being stored on your computer by changing your browser settings. However, if you do so, some features of the Site may be limited. You can also prevent the storage of “Google” data created by cookies and based on your use of the Site (including your IP address) and process such data by downloading and installing the browser plug-in http://tools.google.com/dlpage/gaoptout?hl=pl.

If you visit the Site using a browser that does not have such a plug-in installed, you can disable the recording of “Google Analytics” data by clicking here. This will result in an opt-out cookie that will prevent further data capture when visiting the Site. However, please note that if you delete all browser cookies, the cookie opt-out file will also be deleted.

8.5 Using “Google Adsense”

This Site uses “Google Adsense”, an online advertising service provided by “Google”. “Google Adsense” uses cookies (text files) stored on your computer and allows you to analyze how you use the Site. “Google Adsense” uses web beacons (web beacons), small invisible graphic elements to collect information. Web beacons allow us to capture and collect simple actions, such as traffic on the Site. The information created by the cookie and/or web beacons and related to your use of the Site (including your IP address) is transmitted to and stored on a “Google” server in the US. Google uses this information to evaluate the use of the Website in the context of displaying advertisements in order to create a report to the person managing the Website on Internet activity and promotions, as well as to provide other Internet-related services. As required by law or if third parties manage this data on behalf of “Google”, Google may also share this information with third parties. “Google” will never associate your IP address with other stored data.

In order to opt out of specially tailored advertisements and to request that data not be stored and used, cookies used for the above-mentioned purposes can be disabled by changing the “Google” advertising settings on www.google.pl/settings/ads. Please note that if you delete all cookies, “Google” may place new cookies for these purposes and you may need to update your deactivation settings. In addition, the use of cookies by third parties can also be deactivated on the “Network Advertising” deactivation page at http://www.networkadvertising.org/managing/opt_out.asp.

8.6 Use of “Google Remarketing”

We use “Google” remarketing technology. This technology allows users who have already visited our Site and used our online services and expressed interest in our offerings to receive ads on “Google” partner sites again. The display of advertising is enabled by cookies – small text files stored on the user’s computer. The text files allow us to analyze the behavior of users when they visit Wtryna. They are then used to deliver targeted product recommendations and specially tailored advertising. Data collected by “Google” through customized advertising and third-party data (e.g., age, gender and interests) are recorded by “Google Analytics.”

In order to opt out of specially tailored advertisements and request that the data not be recorded and used, the cookies used for the aforementioned purposes can be disabled by changing the “Google” advertising settings on www.google.pl/settings/ads. Please note that if you delete all cookies, “Google” may place new cookies for these purposes and you may need to update your deactivation settings. In addition, the use of cookies by third parties can also be deactivated on the “Network Advertising” deactivation page at http://www.networkadvertising.org/managing/opt_out.asp.

8.7 Use of cookies by third parties

When using the “Staff In” online services, third parties, third-party providers or web collectors may also use cookies to collect data about you. This may be done to measure your target audience, activate contextual advertising or target your marketing campaign. Once you have given us permission to use cookies, we will also evaluate user profiles with a pseudonym. Identification of the person will not be possible. We do not control the monitoring technology used by third parties or its use.

It is possible to cancel the storage of third-party cookies and monitoring through them of your activities on the Site by changing your browser settings.

8.8 Determination of cookies

The definition of cookies used on our Platform can be found in the Cookie Policy.

9. Right of Amendment

As our services are constantly evolving, we reserve the right to change the Data Protection Policy at any time, in accordance with applicable laws. All changes will be published on this page immediately. Nevertheless, due to updates, you should check this page regularly.

10. The duration of storage of your data

Unless otherwise stipulated in this Data Protection Policy, we will keep:

• the personal data referred to in paragraph 2.1 – 30 days after their registration
• any other personal data contained in this Data Protection Policy – three months from the date of deletion of your “Staff In” account or three months after your account has been inactive for five years.

11. Data rights guaranteed by law

In accordance with statutory data protection regulations, you have the right at any time to:

• information about the Data we Process and to need a copy of that Data (right to be informed). All Data actively transmitted on the Platform (from version 2.2 to 2.6), you can check at any time in your own user account.
• requirements to correct inaccurate data and, in accordance with the nature of management, complete the missing data (right to rectification).
• if there are grounds – the right to require deletion of your data (right to erasure)

request to limit the processing of your Data, if it is in accordance with the criteria set by law (right to limit processing)

• in the case of properly defined legal criteria, you have the right to receive the transmitted Data in a structured form, which can be sent to another Data Controller or, if technically feasible, allow this to be performed to “Staff In” (right to data portability);
• be subject to a non-fully automated decision-making process, unless the conditions set forth in the regulations for such decision-making are met. Currently, “Staff In” does not use automated decision-making.

In addition, in exceptional circumstances, you have the right to reject the statutory Processing of your Data. In the case of Processing of your Data for direct marketing purposes, you may object to such Processing (right to object).

You also have the right to cancel any consent given during registration or use of our services at any time. Such waiver will not affect the legality of the Data Management performed before the refusal and on the basis of the consent given. In the case of the use of cookies, it is possible to use the mechanisms for de-registration and deactivation of cookies created for different services (see the Site’s Privacy Policy for separate services, paragraphs 8.4 and 8.6). In this way, your browser will be provided with a permanent deactivation cookie, informing us that such Data from your browser should not be saved. Please note that if you delete all cookies from your browser, the deactivation cookie will also be deleted. If you use our Platform on a different device or browser, please follow the process described above.

To enforce any of the above-mentioned rights, you can contact “Staff In”. Contact information is provided below. Notwithstanding any other remedies, you have the right at any time to file a complaint with the data protection supervisory authorities in the Member State of your habitual residence, place of work or place where the alleged violation was committed.
